    • If a non-tribal applicant serves tribes or tribal areas, they must have support from those tribes via a Tribal Resolution and/or a letter of support.
  • Federal Grant Eligibility:

    • Must be eligible to receive and administer a Federal grant under Federal law.
  • Legal Authority:

    • Must have or obtain the necessary legal authority for:
      • Owning
      • Constructing
      • Operating
      • Maintaining the facility or service
      • Issuing security for the proposed grant
  • Facility Responsibility:

    • Must be responsible for:
      • Operating, maintaining, and managing the facility
      • Providing continued availability and reasonable user rates, even if a third party operates the facility under contract.
  • Capability:

    • Must demonstrate:
      • Technical, managerial, and financial capability to comply with Federal and State laws and regulations.
  • Debt Status:

    • Must have no delinquent debt to the federal government.
    • Must have no outstanding judgments to repay federal debt.
  • Revenue and Employees:

    • No minimum or maximum revenue requirements.
    • No minimum or maximum employee requirements.
  • Legal and Profit Structure:

    • All legal structures are applicable.
    • Not-for-profit status is required; however, all profit structures are applicable for eligible non-profits.
