- Constructing
- Operating
- Maintaining the facility or service

Facility Responsibility:
- Must be responsible for:
- Operating, maintaining, and managing the facility
- Providing continued availability and reasonable user rates, even if a third party operates the facility under contract.
- Must be responsible for:
Capability:
- Must demonstrate:
- Technical, managerial, and financial capability to comply with Federal and State laws and regulations.
- Must demonstrate:
Debt Status:
- Must have no delinquent debt to the federal government.
- Must have no outstanding judgments to repay federal debt.
Revenue and Employees:
- No minimum or maximum revenue requirements.
- No minimum or maximum employee requirements.
Legal and Profit Structure:
- All legal structures are applicable.
- Not-for-profit status is required; however, all profit structures are applicable for eligible non-profits.
