Qualifications

  • The business must be located in Ontario.
  • The business must be involved in a collective bargaining process with a union.
  • The business must have a union that is either certified or voluntarily recognized.
  • The business must be negotiating a first collective agreement or renewing an existing one.
  • The business must be in a sector that has the ability to strike or lock out.
  • The business must meet with a conciliation officer appointed by the Minister of Labour, Immigration, Training and Skills Development.
  • The business must receive a no-board notice or a notice of a conciliation board's report from the Minister of Labour, Immigration, Training and Skills Development.
  • The business must wait until the 17th day after the no-board notice is released before engaging in a legal strike or lock-out.
  • The business must file a copy of any new collective agreement with the Minister of Labour, Immigration, Training and Skills Development in Microsoft Word or PDF format.
  • The business must ensure that collective agreements are published on the Collective Agreements e-Library website.
  • The business must adhere to the Labour Relations Act, 1995 (LRA) requirements.

Program Steps

  1. Prepare Required Documentation
    Gather the following documents:

    • A copy of the most recent collective agreement (if applicable)
    • A signed copy of the signature page from the most recent collective agreement
    • A copy of the written notice to bargain (if it has been given)
    • A copy of the Ontario Labour Relations Board (OLRB) certification or voluntary recognition agreement (for first agreements)
  2. Notify the Other Party
    Send a written notice to the union or employer indicating your desire to begin negotiations for a new or renewed collective agreement.

  3. Request a Conciliation Officer
    If needed, request the appointment of a conciliation officer by emailing [email protected]. Include the necessary documentation based on whether you are negotiating a first agreement or renewing an existing one.

  4. Meet with the Union or Employer
    Schedule a meeting within 15 days of providing notice to bargain. Ensure both parties are prepared to negotiate in good faith.

  5. Engage in Bargaining
    Participate in the bargaining process, making every reasonable effort to reach a collective agreement.

  6. File the Collective Agreement
    Once an agreement is reached, file a copy with the Minister of Labour, Immigration, Training and Skills Development in Microsoft Word or PDF format.

  7. Conduct a Ratification Vote
    If applicable, hold a ratification vote among bargaining unit employees to approve the new collective agreement.

  8. Submit the Ratified Agreement
    After ratification, ensure the new agreement is submitted online through the collective agreement submission page.
